Additional Tariffs on Imports from Europe Announced
LATE MONDAY THE USTR ANNOUNCED A SUPPLEMENTAL LIST OF 89 TARIFF ITEMS FROM THE EUROPEAN UNION THAT ARE BEING PROPOSED FOR ADDITIONAL TARIFFS.

These tariff items are valued at approximately $4 billion dollars based on 2018 import value.
This list supplements a previous list issue on April 12 and discussed in our earlier client alert.
It is a further escalation of the trade dispute with Europe based on the U.S. allegations of the EU granting WTO-inconsistent subsidies to large civil aircraft. The list is set out in the proposed Federal Register notice. The proposed second list includes products like cheeses, olives, fruits, and pasta, along with copper and other metals. The first list also included civil aircraft from several European countries. The EU has also published a list of U.S. goods worth $12 billion that it would hit with retaliatory tariffs for illegal subsidies the U.S. provides to Boeing.
The U.S Trade Representative(USTR) is soliciting comments until August 5, 2019, with a public hearing scheduled for the same day. Requests to appear at the hearing that must be accompanied by a summary of testimony are due by July 24, 2019. Post-hearing submissions are due by August 12, 2019
The items on the new list are being proposed for additional tariffs of up to 100%. Some of these new items resulted from comments submitted to the previous proposed list and testimony at the hearings on May 15-16, 2019 where some parties suggested additional products to be added to the list. After the hearings to be held in August, the USTR will issue a final list of products that will be subject to the new tariffs.
Public comments should address the specific items on the list that are of concern, the level of increase if any in the rate of duty, and whether the increased duties on particular products might have an adverse effect upon US stakeholders, particularly small businesses and consumer. A large number of items on the list are food and dairy products, but chemicals and metal products are also included.
