Butzel Long attorneys co-author Chapter in Defense Research Institute book on trade secrets and non-competes

DETROIT, Mich. – Butzel Long attorneys Phillip C. Korovesis, Bernard J. Fuhs and Dominic A. Paluzzi have co-authored a chapter in a new Defense Research Institute (DRI) book titled, Trade Secrets and Agreements Not to Compete. DRI is the international organization of attorneys defending the interests of business and individuals in civil litigation.
The book is a compendium of state law in the areas of trade secrets and non-competition covenants. The book is a project of the DRI Commercial Litigation Committee and describes each state's law and procedure in these increasingly important subject areas.
The chapter authors are lawyers who regularly practice in the two closely related areas. They advise employers in their states as they draft non-competes and seek protection for the secrets the employers have developed over the years. This publication is written for lawyers who work closely with employers to protect their clients' interests.
The content of the book is based on the conflict between two fundamental business interests: the entrepreneurial right to engage in whatever business an American wishes to pursue free of unreasonable restraints, and the right of an employer to protect the business know-how it has shared with its employees.
In the 51 trade secrets chapters, the book examines the Uniform Trade Secrets Act and the extent of its adoption by most states. This includes the basic definitions of "trade secret" and "misappropriation," and the types of information that courts will or will not protect and allow an employer to hold confidential.
In the 51 non-compete chapters, the book focuses on the enforceability of prior agreements between an employer and an employee who then leaves the employer.
About the authors
Phillip C. Korovesis
Mr. Korovesis is the Chair of Butzel Long's Non-Compete and Trade Secret Practice Group which focuses on trade secret, non-compete and business tort litigation. He has presented numerous programs on trade secret and non-compete issues to industry representatives and other lawyers.
Mr. Korovesis' practice is focused on commercial disputes, with trial, litigation and consultation expertise in the following areas: non-compete/trade secret, product liability defense, life insurance claims, business disputes and securities related disputes. Mr. Korovesis has successfully tried cases in state and federal courts, and has successfully represented clients in state and federal appellate courts. He also has successfully arbitrated cases before the American Arbitration Association, the National Association of Securities Dealers, and the New York Stock Exchange (now The Financial Industry Regulatory Authority).
Bernard J. Fuhs
Mr. Fuhs concentrates his practice in the areas of business litigation and general corporate law. He has significant experience in the following areas: non-compete/non-disclosure/trade secret, franchise law and franchise litigation, business disputes, corporate and limited liability organization and operation, corporate transactions, and finance law. He also advises start-up and closely held businesses, as well as sports and fitness industry members.
Dominic A. Paluzzi
Mr. Paluzzi concentrates his practice in the areas of business litigation and trade secret and non-compete law. He has extensive experience in the real estate and new construction industries and also has worked in automotive logistics management and corporate energy forecasting.
