Butzel Long attorneys featured during OESA Commercial Trends and Legal Strategy v.2011 program

DETROIT, Mich. – Several Butzel Long attorneys were featured presenters during the Original Equipment Suppliers Association (OESA) Commercial Trends and Legal Strategy v.2011 program and webinar on October 27, 2011 in Troy. Featured Butzel Long attorneys included: Cynthia J. Haffey, Sheldon H. Klein, Jennifer A. Dukarski, James C. Bruno, Katherine Donohue Goudie and Beverly M. Bunting.
OESA and Butzel Long partnered to develop the “Comparative Analysis,” which compares terms and conditions of BMW, Chrysler, Daimler, Ford, GM, Honda, Hyundi, Kia, Nissan, Toyota and VW as well as the “OESA Model Terms and Condition.” The Comparative Analysis was created in 2008, and updated in 2009, 2010 and 2011.
“Our objective was to provide timely information focused on commercial relationships and supply chain issues as well as key legal topics,” said Sheldon Klein.

Cynthia Haffey addressed changes and updates to the “OESA OEM Production P.O. Terms and Conditions Comparative Analysis.”
Sheldon Klein discussed the rights and obligations of a buyer and seller that flow from the acceptance, rejection or revocation of non-conforming parts.
Jennifer Dukarski, a mechanical engineer with more than a decade’s experience in automotive quality and program management, offered perspective for addressing root cause analysis to protect supplier rights in product quality disputes.
Jim Bruno discussed the statute of frauds, volume fluctuation and other potential pitfalls and controversies arising from requirements contracts.
Katherine Donohue Goudie addressed important questions regarding the enforceability and effectiveness of non-compete and other agreements as a tool in protecting key personnel.
Beverly Bunting discussed how the new patent law affects supply chain contracting, specifically the steps suppliers should take to protect their intellectual property.
