Overview
Sheldon H. Klein is a Shareholder based in Butzel’s Troy office.
Mr. Klein regularly represents automotive industry suppliers in matters relating to upstream and downstream commercial relationships, including counseling on terms and conditions and litigation arising out of supply chain disruptions and disputes. He is Co-Chair of Butzel's Global Automotive Coordinating Committee. He is a contributor to and principal editor of MEMA's (formerly known as the Original Equipment Supplier Association/OESA) “North American OEM Production P.O. Terms and Conditions Comparative Analysis,” the standard industry reference, which Butzel has prepared annually since 2008. He is also a regular speaker at automotive industry events, including MEMA's annual Automotive Suppliers Legal Issues Conference, in which Butzel attorneys address current and emerging legal issues affecting the industry.
Mr. Klein also regularly represents automotive and other clients in the areas of antitrust counseling and litigation and other forms of complex commercial litigation. Representative class action matters include representation of:
- A major hospital system in an antitrust class action alleging a conspiracy by area hospital systems to suppress nurse compensation.
- A major hospital system in an antitrust class action alleging a conspiracy to inflate reimbursement rates.
- A real estate multi-list service (MLS) in an antitrust enforcement proceeding and civil suit alleging a conspiracy to deny low cost brokers access to the MLS.
- A major name brand pharmaceutical company in an indirect purchaser name brand prescription drug antitrust class action, which alleging a conspiracy to inflate prescription drug prices to retail pharmacies.
- An international manufacturing conglomerate in an antitrust compliance investigation and audit.
- An automotive parts supplier in an antitrust class action alleging a horizontal price-fixing conspiracy.
- A second automotive parts supplier in an antitrust class action also alleging a horizontal price-fixing conspiracy.
- A CEO in securities fraud and ERISA breach of fiduciary duty class action litigation.
- A CFO securities fraud class action litigation.
- An insurer in a workers' compensation price fixing conspiracy class action.
- An entertainment company in a consumer fraud class action.
- An underwriter and its officers in a securities fraud and Interstate Land Sales Act fraud claims.
- A health insurer and its senior officers a securities fraud class action.

Mr. Klein is a 1978 graduate of Kalamazoo College and a 1982 graduate of DePaul University School of Law. He is a member of the State Bar of Michigan and the American Bar Association.
